The case (decided 2 March 2023) was heard by a five-judge Constitution Bench headed by Justice K.M. Joseph, which ruled that the CEC and Election Commissioners be appointed on the advice of a committee of the Prime Minister, the Leader of the Opposition and the Chief Justice of India until Parliament makes a law. It did not equate the removal of Election Commissioners with that of the CJI: the majority left Article 324(5) as it is (only the CEC is removable like a Supreme Court judge), and only Justice Rastogi's separate opinion suggested giving the other ECs the same protection as the CEC.
