   Answer: During the period of National Emergency, the President acquires discretionary powers, and can take independent decisions.

   Even during a National Emergency the President must act on the advice of the Council of Ministers. The 42nd Amendment made that advice binding under Article 74(1), and the 44th Amendment only lets him return it once for reconsideration, so an emergency gives him no independent discretion.
