Answer: Where the Governor acts without the aid and advice of the Council of Ministers and acts in his own discretion

Under Article 163(2), the Governor's decision on whether a matter is in his discretion is final, and what he does in his discretion cannot be questioned on the ground that he ought or ought not to have acted in his discretion.
